1.- DATA PROTECTION. AQUA HOTEL GRUP undertakes to comply with current regulations on the processing of personal data within the framework of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. AQUA HOTEL GRUP will treat the data of its clients in an automated way and guarantees that the files where the information is contained, where appropriate, are of its full responsibility, and will be treated in a lawful, loyal, transparent, adequate and limited manner. 2.- SERVICES AND RESERVATIONS. By completing the services and reservations form, each owner authorizes AQUA HOTEL GRUP to use and automatically process the personal data provided in order to proceed with the requested reservation and/or manage services and/or commercial products offered on www.atzavarahotel.com.

The client who makes a reservation is informed that their personal data will be transferred to the destination hotel, in order to manage the reservation and guarantee its execution, without being able to use it for any other purpose unless is expressly authorized.

3.- CONFIDENTIALITY. AQUA HOTEL GRUP guarantees the confidentiality of the personal data of its users, as well as using the security measures established in the Spanish regulations on data protection regarding third parties, although it will disclose to the competent Public Authorities the personal data available if necessary required by the Authority in accordance with current legislation.

GENERAL CONDITIONS OF THE CONTRACT

 The use of the services or the contracting of products of AQUA HOTEL GRUP supposes the acceptance of the following general conditions, so that you declare and accept:

 1.- Be of legal age (over 18 years of age) and have the necessary legal capacity to contract the services offered on the atzavarahotel.com website, stating that you understand all the conditions of use found in the legal information section, conditions of use and privacy policy of the beginning of the web page and of these general conditions.

 2.- In order to contract the services offered, the user must not register as a client, but must provide some essential information for identification and making the reservation, such as name and surname, address and any other information required by the page for contracting. of the service, for which purpose it declares that all the information provided at the time of contracting is true, complete and concise.

 3.- This website is for your personal and never commercial use, so the reservation of the products and services offered by natural or legal persons acting as intermediaries for their subsequent resale or distribution is prohibited. AQUA HOTEL GRUP reserves the right to limit the number of reservations contracted by the same person or client, as well as depending on the availability of the hotels and the programming of the contracting outside the Internet.

4.- Only those pages that appear within the web map are included in the web.

 5.- In accordance with the provisions of the conditions of use contained in the legal information, conditions of use and privacy policy section, which you declare to know and accept, access to this website is the sole responsibility of the users.

 6.- By making the reservation in accordance with the instructions on the page, you confirm the dates indicated, as well as the number of rooms, the number of people and the chosen Hotel. The conditions and price of the contracted reservation are those that are expressly determined on the web and that have been expressly accepted by you. The price of the reservation includes accommodation, breakfast and the contracted half or full board, if any, but does not include any other optional "extra" or any other service that is not expressly contracted through the atzavarahotel.com system. The reservation prices include VAT, unless is expressly omitted. Any other rate or tax that accrues for the accommodation will be settled additionally at the establishment.

 7.- The confirmation of the reservation implies the registration of the credit card provided by you, the amount of which will be indicated on the screen in the reservation acceptance process. The total amount of the price will be paid directly at the hotel.

CANCELLATION POLICY

The credit card is required only as a guarantee of your reservation, except if you have booked with a non-refundable rate or with a down payment. Flexibility in cancelling the reservation. If you wish to cancel before your arrival, please contact the hotel. In case of subsequent cancellation or no-show at the hotel, the full amount of the first night per reserved room will be charged to the credit card indicated in the reservation.

Cancellation policy only valid for reservations with "NON-REFUNDABLE RATE": 

In case of cancellation, modification or no-show at the establishment, the total amount of the stay will be charged.

Important information for modifications:

The client may request modifications by email or by phone call to Aqua Hotel (Tel.:0034 93/767 87 74). Any request to modify the reservation is subject to the availability of the establishment at the time of the request and may entail a change in the rate. The request to modify reservations can be made up to 24 hours before arrival. Any changes will be updated with the price in effect at the time of the change.

8.- In accordance with the provisions of art. 3.2 of Royal Decree 1906/1999, of December 17, which regulates telephone or electronic contracting with general conditions, and in art. 28.1.b) of Law 34/2002, of July 11, on services of the information society and electronic commerce, this contract is a single contract and AQUA HOTEL GRUP will send confirmation of the reservation as soon as possible since the acceptor has completed the reservation procedure, and will do so to the email address previously provided by the acceptor.

9.- In accordance with the provisions of art. 27.3 of Law 34/2002, of July 11, on services of the information society and electronic commerce, all offers will only be valid during the time that they remain accessible to the recipients of the service for their effective contracting through the system established in www.atzavarahotel.com.  

10.- In the event that AQUA HOTEL GRUP communicates the cancellation of the reservation for reasons of force majeure, understanding as such those circumstances beyond the control of the person invoking them, abnormal and unforeseeable, whose consequences could not have been avoided despite having acted with due diligence, the reservation will be cancelled without the right to claim or compensation by the user or client. Said assumption must be communicated, if possible, through the channel used to confirm the reservation.

11.- In accordance with the provisions of arts. 21 and 22 of Law 34/2002, of July 11, on services of the information society and electronic commerce, AQUA HOTEL GRUP may send commercial advertising of its products and services to the email provided by the acceptor if he so authorizes it in the selection that will be shown to you in the reservation process. The acceptor can revoke his consent at any time by sending an e-mail to info@aquahotelgrup.com.

12.- All notifications, requirements, requests and other communications that have to be made by the parties in relation to these general conditions, must be made in writing and it will be understood that they have been duly made when they have been sent by fax, delivered by hand or sent by ordinary mail to the address of the other party or to the latter's email address.

13.- If one or more of the clauses included in the general conditions or in the conditions of use were declared totally or partially null or ineffective, it will affect only said provision or that part that has been so declared, subsisting the general conditions or the conditions of use in everything else, considering such provision, or the part thereof affected.

14.- The user accepts that the legislation applicable to the operation of this service is Spanish and submits to the jurisdiction of the Courts and Tribunals of Arenys de Mar, Barcelona, for the resolution of differences arising from this interpretation or application of this clause. AQUA HOTEL GRUP reserves the right to make any changes it deems appropriate to the established terms and conditions. The applicable regulations are governed by the following provisions:

Law 7/1998, of April 13, on General Contracting Conditions, Law 26/1984, July 19, General for the Defense of Consumers and Users, Law 7/1996, of January 15, on Retail Trade Regulation, Royal Decree 1906/1999, of December 17, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999 on the Protection of Personal Data, Royal Decree 994/1999, of June 11, which develops the aforementioned organic law, and Law 34/2002, of July 11, on Company Services of Information and Electronic Commerce, and subsidiarily Civil Code and Commercial Code.
